USC COVID-19 Terms and Conditions

I understand that compliance with all of USC’s COVID-19 health and safety protocols is mandatory for all attendees at USC events, and I agree that I will comply with them. I understand that these protocols may change from time to time, and I agree that I will comply with the then-current protocols and will comply with instructions provided by USC staff. I recognize that these protocols include but are not limited to:

Wearing an appropriate face covering that fully covers the mouth and nose at all times on USC premises, except while actively eating or drinking.

In accordance with California’s current guidelines, the University and Event Organizer is requiring fans agree to the terms below prior to ticket purchases & event entry: By purchasing tickets for this event, I confirm that at the time of the event I will either have been fully vaccinated, received a negative Covid-19 test within 72 hours of the event, and agree to wear a mask for the duration of the event. Please note this requirement will apply to all members of your party before they are allowed to enter the event.

I understand that complying with USC’s COVID-19 protocols is a part of my responsibility to protect myself, and by doing so, protect others in USC’s community during the pandemic. I understand that failure to comply with USC’s COVID-19 protocols may result in USC denying me admission and/or removing and banning me from the premises. I understand that these Terms and Conditions are applicable to all persons in my audience group. Therefore, I also attest that all members of my audience group will review and accept these COVID-19 Terms and Conditions.

I also understand and acknowledge that, despite the health and safety measures that USC is instituting to help protect staff, faculty, students, and campus visitors from COVID-19, an inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. I understand and acknowledge that attending any in-person event may expose me to a variety of hazards and risks foreseen and unforeseen related to COVID-19 and that I may expose those within my household or with whom I interact to the same. I am purchasing or requesting seat reservations with full knowledge of the existence of these risks and hazards.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself and to all other persons who will use the tickets that I purchase or request. I hereby release, discharge, hold harmless, and agree not to sue USC or its agents, employees, representatives, or affiliates for any claims that relate to COVID-19, including all liabilities, actions, damages, costs, or expenses of any kind arising out of or relating thereto, on behalf of myself and my representatives, heirs, spouse, guardians, executors, administrators, successors, assigns, and next of kin, to the fullest extent permitted by law. I agree that this release includes, without limitation, those claims that arise as a result of (1) the negligence of USC or any of its agents, employees, representatives, or affiliates, and/or (2) the inherent risks associated with being present on USC’s premises or at any USC event.

I am familiar with and do hereby waive the provisions of Section 1542 of the California Civil Code (and similar provisions of other jurisdictions) which provides as follows:

‘A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.’

I also understand that all USC events shall be subject to USC’s reasonable determination regarding the health and safety of its students and staff. If guidelines of any governmental agency or athletic governing body prevents USC from hosting the event, or if USC determines that it is unsafe to hold the event, USC may cancel or reschedule the event as necessary to ensure the health and safety of all of its students and staff.

If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable. This Agreement contains the complete and exclusive statement of the parties’ agreement as to matters set forth herein and replaces and supersedes all of their prior written or oral, express or implied, agreements, understandings, communications or statements about those matters. This Agreement shall be construed and enforced in accordance with the laws of the State of California applicable to agreements of this nature, or where pre-empted, by the appropriate body of federal law, and I hereby consent to the exclusive jurisdiction of said State.
